Terms of Service

Please find two sets of Terms & Conditions below, the first for Flyte Hops, the second for Flyte Luxe.

Welcome to Flyte. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

1. Services Overview

Flyte provides a technology platform that connects travelers with private aviation services. We are not an aircraft operator. The Flyte app is a technology platform connecting travelers with either our wholly owned subsidiary Ponderosa Air LLC or other FAA-approved Part 135 carriers. Flyte functions as a charter broker working on behalf of its clients, as defined by DOT 14 CFR part 295.

2. Account Registration

To use certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Booking and Payment

3.1 Booking Process

When you book a flight through our Services, you are entering into an agreement with the aircraft operator, not with Flyte. We act as an intermediary to facilitate the booking process.

All bookings are subject to aircraft and crew availability. We reserve the right to substitute aircraft of similar or greater capability if necessary.

3.2 Payment Terms

Payment is required at the time of booking unless otherwise specified. We accept major credit cards and wire transfers. All prices are quoted in US dollars unless otherwise specified.

Additional charges may apply for changes to your itinerary, ground transportation, catering, or other services requested after booking.

3.3 Taxes and Fees

All prices are exclusive of applicable taxes, fees, and surcharges unless otherwise specified. These may include, but are not limited to, Federal Excise Tax (FET), segment fees, passenger facility charges, international fees, customs fees, and security charges.

4. Cancellation and Refund Policy

4.1 Cancellation by You

Standard cancellation policies apply to all Flyte services:

  • Cancellations made more than 72 hours before scheduled departure will receive a full refund minus a 5% processing fee.
  • Cancellations made within 72 hours of scheduled departure will be charged 50% of the total booking price.
  • For specialty packages and Flyte Escapes: Cancellation policies will be specified at the time of booking and may vary based on the specific package.

4.2 Cancellation by Us or the Operator

We or the aircraft operator may cancel a flight due to circumstances beyond our control, including but not limited to weather conditions, mechanical issues, crew availability, or regulatory requirements. In such cases, we will make reasonable efforts to arrange alternative transportation or provide a full refund.

5. Travel Documents and Requirements

You are responsible for obtaining and carrying all necessary travel documents, including passports, visas, and health certificates. You must comply with all applicable laws, regulations, and requirements of the departure and destination locations.

We are not responsible for any consequences resulting from your failure to obtain or carry the necessary travel documents or comply with applicable laws and regulations.

6. Conduct and Compliance

You agree to comply with all instructions given by the aircraft crew and to behave in a manner that does not cause discomfort, inconvenience, or damage to other passengers or the aircraft.

The aircraft operator reserves the right to refuse carriage to any person who, in the operator's reasonable opinion, is under the influence of alcohol or drugs, or whose behavior poses a risk to the safety or comfort of other passengers or the aircraft.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Flyte and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of the Services.

Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to us for the Services giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Flyte and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your violation of any applicable laws, rules, or regulations

9. Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Flyte or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or through a notice on our website prior to the changes becoming effective. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

11. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice or conflict of law provision or rule.
